Can I put a tier 2 claim through a tier 1

There is a tier 1 claim thats area includes some prime river and they have no intention of working the river iss there a way i could claim it, would I have to get permission or buy the area off them

Easiest way is just get an agreement with claim owner to work the river under their permit.
